Revenge Porn goes ‘Down Under’

1 in 5 Australians have had images or videos of a nude or sexual nature taken without their consent

11% of people have had images distributed without consent

9% of respondents said they received threats that the images would be shared.

A study from RMIT and Monash universities has found the prevalence of revenge porn is rapidly growing, and both men and women are equally likely to be victims.

Revenge porn has been present in Australia for many years, and in many States the law is still playing catch-up. In Australia, each State Government (and the Federal Government) has the power to introduce bills and implement laws that tackle revenge porn head-on.

In November 2016, the Australian Minister for Women, Senator Michaelia Cash, said the Commonwealth Government was considering penalties for revenge porn perpetrators and the websites that host their material. After a Senate committee announced the growing phenomenon should be criminalised nationally, the Turnbull Government have hinted at introducing legislation by the end of the year. (Lee, 2016)

Specific laws aimed at targeting revenge porn currently exist in only SA and VIC – meaning QLD, NSW, ACT, TAS, NT and WA are lagging behind on this alarming issue. 9 News in South Australia aired a story on the revenge porn laws that were introduced into state parliament in the early months of 2016.

In March, ABC program Q&A explored the topic of revenge porn. National debate followed, which primarily addressed the role of the government in deterring and punishing perpetrators, whilst protecting victims.
